ORDINANCE NO. 242-06
VILLAGE OF UNADILLA
TO REPLACE ORDINANCE NO. 226-03, SPECIFICALLY BANNING THE USE OF BURNING BARRELS AND REGULATING VOLUNTARY BURNING OF MATERIALS WITHIN THE VILLAGE OF UNADILLA; AND TO PROVIDE PENALTIES FOR THE VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF UNADILLA, NEBRASKA:
Section 1. BURNING DEFINED. Burning shall be defined as the igniting of any materials which cause a fire to ensue.
Section 2. OPEN BURNING. It shall be unlawful for any person to cause, suffer, allow, or permit open burning of refuse material (specifically, but not limited to burning barrels) within the corporate limits of Unadilla with the following exception:
1. Fires set solely for recreational purposes or for outdoor cooking of food for human consumption on other than commercial premises; or for warmth as provided by a fireplace.
Section 3. PERMITS. A permit from the Fire Chief shall be required for all other types of voluntary fires.
Section 4. PENALTY. Any person who knowingly violates any of the provisions of this Ordinance shall be fined in the sum of $50.00 for the first violation and $100.00 for each following violation.
Section 5. CONFLICT. That any other ordinances or sections passed and approved prior to the passage, approval, and publication or posting of this ordinance and in conflict with its provisions, is hereby repealed.
Section 6. EFFECTIVE DATE. This ordinance shall take effect 1-1-2007 and be in full force from this date after its passage, approval, and publication or posting, as required by law.
